CareGene Inc. Terms of Service

CareGene Inc. ("CareGene", "we", "us", or "our") provides a platform designed by rare disease families to help other families manage complex medical narratives. By creating an account or using our website and tools, you agree to be bound by these Terms of Service. These terms form a legally binding agreement between you and CareGene Inc. regarding your use of our services.

Our services are designed for parents, legal guardians, and adult caregivers of individuals with complex medical needs. You must be at least 18 years of age to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your "Vault". You agree to notify us immediately of any unauthorized access to your clinical data.

Care Team Access:

You may invite additional caregivers (family members, healthcare providers, therapists) to access your child's Vault. You are responsible for managing these permissions and may revoke access at any time. Each invited caregiver must agree to these Terms of Service.

CareGene is a technology company, not a healthcare provider. We do not provide medical advice, diagnosis, or treatment recommendations.

• The Tool: CareGene is a "Medical Memory" tool designed to help you organize and summarize fragmented records into a continuous clinical story.
• The Specialist: Our generated briefs and AI insights are intended to support your conversations with licensed medical professionals.
• Emergency Use: Do not use CareGene in the event of a medical emergency. Always seek the advice of a physician or other qualified health provider with any questions regarding a medical condition.

You retain full ownership of all medical records, voice logs, and personal data you upload to the platform. We call this your Clinical Narrative.

• License to CareGene: You grant us a limited, secure license to process your data solely to provide the services you request, such as generating clinical briefs or indexing your records.
• The Sentinel Pledge: We will never sell your clinical narrative to third parties or use your private data to train public AI models.
• Responsibility: You represent that you have the legal right to upload and manage the medical information of the individual represented in your account.
• Voice Recordings: Voice logs you submit are processed to extract clinical observations and are stored as part of your Clinical Narrative. Original audio may be retained for accuracy verification or deleted per your preference in Settings.

You may choose to participate in approved research studies by providing explicit consent through our Research Consent Manager.

Participation is:

• Entirely voluntary
• Revocable at any time
• Study-specific (consenting to one study does not consent to all)

CareGene will provide clear disclosures about each study including:

• Research sponsor and principal investigator
• Study purpose and duration
• Data to be shared
• Compensation (if any)

By participating, you agree that de-identified data may be used for peer-reviewed publications and regulatory submissions (e.g., FDA natural history studies).

Advocacy Group Integration:

If you choose to connect your CareGene account to a patient advocacy organization's registry, data sharing will be governed by both these Terms and the advocacy group's data policies. You can disconnect from any registry at any time.

Our platform utilizes automated systems, including Sage, our AI records assistant, to help you organize and retrieve information from records you have logged or imported. Sage is not a clinician, diagnostician, or clinical decision support tool.

• Citations: Sage cites the source document or note for every fact it surfaces, so you can verify each answer against the original record.
• No Guessing: If the information is not in your records, Sage will tell you instead of guessing or supplementing with general medical knowledge.
• Limitations: AI can make errors. You should verify all AI-generated summaries against your original source documents and discuss any clinical questions with your child's care team.

You acknowledge that the services available to you may evolve as we release our MVP tools: Sage (AI records assistant), Action Center (appointment prep, visit recording, and provider imports), Today (your daily home for milestones, sleep, symptoms, and medications), and Living Diary (the unified timeline that holds your records and your observations together).

CareGene is intentionally bootstrapped and independent. This independence allows us to prioritize family privacy over investor returns. We reserve the right to charge fees for specific premium features. Any such fees will be clearly communicated to you before you incur any charges.

You agree not to use our services to:

• Upload data you do not have the legal authority to manage.
• Attempt to bypass our security protocols or access the isolated "Vaults" of other families.
• Use the services to build a competing product or service.
• Interfere with the operation of our system or the integrity of our clinical data processing.

You may terminate your account at any time. Upon termination, we will delete your Clinical Narrative and Personal Information from our production systems, subject to our standard backup rotation cycles. CareGene reserves the right to suspend or terminate your access if you violate these terms.

To the maximum extent permitted by law, CareGene Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the services. We provide the platform on an "as-is" and "as-available" basis. We do not warrant that the services will be uninterrupted or error-free.

You agree to indemnify and hold CareGene Inc., its family-member founders, and its partners harmless from any claims, losses, or expenses arising from your violation of these terms or your misuse of the platform.

These terms are governed by the laws of the State of Delaware, United States. Any disputes arising from these terms shall be resolved in the courts of the State of Delaware.

We may update these terms as we grow and launch new tools. If we make significant changes, we will notify you through the platform or via the email address associated with your account. Your continued use of CareGene after such changes constitutes your acceptance of the new terms.
